A note to my Senators and House member regarding constitutional violations.
5th Amendment – "nor shall private property be taken for public use, without just compensation." "nor be deprived of life, liberty, or property without due process of law." The asset forfeiture laws and the stop and frisk laws in NYC and Rikers prison in NY was exposed for holding 400 prisoners without charge, one for 1000 days who after being released committed suicide.
4th Amendment – "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated" - Section 215 of the Patriot Act that allows spying without due process on the American people. No person need come forth and "upon probably cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
8th Amendment – Excessive bail and fines beyond the ability to pay. These are being imposed by many jurisdictions such as Ferguson, MO where there are more tickets and fines per year than their are citizens. They go to court and unreasonable fines are imposed that they cannot pay so they are placed in jail until the fines are paid and hey does this not sound like a modern day version of debtor's prison? and I’ve seen it in TX, where more than a thousand Texas teenagers have been ordered to lockup on charges that stem from missing school, often because they have unpaid court fines. 14th Sec 1 – The rights to due process under the law. At least two cities I know of violating this right. Chicago recently was exposed for having illegal imprisonment without charge and recently
Article III – States our courts are to adjudicate US laws, yet recently the WTO has ordered the US to strike down law based on a trade deal, so our trade deals violate the US Constitution in a multitude of ways. The current TPP has this Investor State Dispute or ISDS which is much like a corporate world court that can strike down any law of member nations that might possibly hamper a corporate profit. How is this not a violation of our Constitution?
1st Amendment - Rights of free speech and the right of peaceful assembly – Many states are passing laws suppressing free speech of the people with laws such as Ag Gag laws, even voter ID laws are preventing many from expressing their political free speech at the ballot box.
